Privacy Policy and Processing of Personal Data.

This Privacy Policy and Processing of Personal Data (hereinafter referred to as the "Policy") is an annex to the Public Offer Agreement (hereinafter referred to as the "Agreement") and is an integral part of it. Definitions capitalized are used in the meaning provided to them in the Agreement, unless otherwise directly follows from the text of the policy.

  1. Definition of Terms.

1.1. Personal data - information or a combination of information regarding an individual who is identified or can be specifically identified.

1.2. Owner of personal data - an individual or legal entity that determines the purpose of processing personal data, establishes the composition of this data and procedures for processing it, unless otherwise defined by law.

1.3. Manager of personal data - an individual or legal entity to whom the owner of personal data or the law has granted the right to process this data on behalf of the owner.

1.4. Subject of personal data - an individual whose personal data is processed.

1.5. Processing of personal data - any action or combination of actions such as collection, registration, accumulation, storage, modification, renewal, usage and distribution (distribution, implementation, transfer), destruction of personal data, including using information (automated) systems.

2. Volume and Purpose of Collecting PD.

2.1. The Company collects the following PD (personal data of Platform Users):

2.1.1. user data provided by them during registration on the platform, including but not limited to the following:- Full Name;- contact data (email address, phone number, etc.);

2.1.2. data automatically transmitted during their use using the software installed on the user's device, including IP address, information from cookies, information about the user's browser (or another program used to access the Platform), time of access, address of the requested page.

2.1.3. user data entered by them or other Users into the Platform or formed by the Platform when using the platform to provide and receive services, including but not limited to:- information containing medical secrets;- history of service orders.

2.1.4. Other data provided for by the Agreement, this Policy, or the law.

2.2. The purpose of processing PD is:- ensuring the use of the Platform by Users and the provision and receipt of services by users;- providing the user or persons specified by him with quick and convenient access to the user's personal data, in particular, to the result of the services provided, obtaining additional useful information related to the results of the services provided, as well as for other similar purposes related to services;- fulfilling the obligations of the Company and Performers imposed on them by law;- improving the quality of the platform, developing new services that can be provided to Users;- using anonymized data for statistical purposes;- targeting advertisements.

3. Consent to the processing of PD and the rights of the user as a subject of personal data.

3.1. The user, by placing a mark of consent to process PD and agreeing to the terms of this Policy:

3.1.1. voluntarily provides the Company with his consent to automated, as well as non-automated processing, including collection, registration, systematization, accumulation, storage, modification, renewal, use, and distribution (including transfer and cross-border transfer and distribution), anonymization, blocking of his PD, in the volume and purpose provided for by this Policy and the Agreement;

3.1.2. does not require to be informed about the transfer (distribution) of his PD, voluntarily provided to the Company, to third parties or obtaining the user's consent for such transfer if this transfer (distribution) is carried out to implement the legal relationships conditioned by the agreement;

3.1.3. confirms his consent to provide his PD upon written request to the Performer (who has already provided the Service to this User). Such information may be provided to the applicant in the form of a letter sent by email. Users confirm that they will take all necessary measures to prevent unauthorized persons from accessing emails.

3.1.4. agrees to receive from the Company, by any means of communication, textual, multimedia, and voice messages (including SMS and MMS) with information about platform services, news, and any other messages of advertising, commercial, or promotional nature. The user can unsubscribe from such messages by sending an email to manager@ipsycholog.net;

3.1.5. confirms that he has been informed in writing by the Company about the collection of his PD at the time of their collection, their content, the owner of PD, the purpose of collection, and the persons to whom they are transferred, as well as his rights provided for in Article 8 of the law, according to which the subject of PD has the right:

3.1.5.1. to know about the sources of collection, location of his PD, the purpose of their processing, the location or place of residence (stay) of the owner or manager of PD, or to give the appropriate authorization to receive this information by authorized persons, except for cases established by law;

3.1.5.2. to receive information about the conditions for providing access to PD, including information about third parties to whom his PD is transferred;

3.1.5.3. to access his PD;

3.1.5.4. to receive, no later than thirty calendar days from the date of receiving the request, unless otherwise provided by law, a response about whether his PD is being processed, as well as to receive the content of such PD;

3.1.5.5. to submit a motivated demand to the PD manager objecting to the processing of his PD;

3.1.5.6. to submit a motivated demand to amend or destroy his PD by any owner or manager of PD, if these data are processed unlawfully or are unreliable;

3.1.5.7. to protect his PD from unlawful processing and accidental loss, destruction, damage in connection with intentional concealment, non-provision, or untimely provision, as well as protection from information that is unreliable or damaging to the honor, dignity, and business reputation of an individual;

3.2. The user also has the right to demand the removal of his PD from the platform by the Company. In this case, the Company deletes the user's PD from the platform that he demands to delete, except for those that must be stored by the Company in compliance with the legislation of Ukraine. In case of such data deletion, the Company may delete the User's Personal Account and terminate the User's access to the Platform and prevent the possibility of obtaining services from the platform.

3.3. The consent given by the User for the processing of PD is valid for an indefinite period and can be withdrawn at any time. Declarations of withdrawal of consent for processing their PD and other declarations and requests for the realization of users' rights as data subjects should be sent by Users in writing to the address: 03038, Ukraine, Kyiv, Novovokzalnaya St. 3.

3.4. The user agrees that if his authorized person has entered data on the platform for the provision of services in special computer and/or information programs (systems), installed on all, including portable media, the user has given prior consent to such a person to use his PD, with the list of services and wishes to receive exactly such services, and confirms that such an authorized person acted on behalf of the user and in his interests. The user confirms that he gives the right to such an authorized person to give consent on his behalf to process PD. If during the preliminary filling out of the form for the provision of services in special computer and/or information programs (systems), installed on all, including portable media, the email address of a third party was marked, the User agrees to send messages related to his service order to this email address. Responsibility for the correctness of the email and the confidentiality of information after its receipt lies with the third party.

3.5. Withdrawal by the User of consent to process PD leads to the deletion of the User's Personal Account and cessation of his access to the Platform and prevention of the possibility of obtaining services using the platform.

4. Processing of PD and Confidentiality

4.1. Any PD or other information placed, distributed, or access to which is provided by the User on the platform is confidential and is processed in accordance with the Agreement and this Policy.

4.2. For the purposes and understanding of current legislation (including but not limited to the Law of Ukraine "On Personal Data Protection"), the owner and manager of PD is the Company (LLC "PSYCHOLOGIST ONLINE", a legal entity under the legislation of Ukraine, EDRPOU code 38578224).

4.3. The Parties undertake obligations to maintain the confidentiality of information received during the implementation of the provisions of the Agreement.

4.4. Clients understand and agree that in order to receive Services, it is recommended for them to provide complete and reliable information to the Performer, requested by him for the provision of the Service.

4.5. The Company conducts audio and video recordings of user actions on the platform to carry out further management of the platform. Such recordings are considered confidential by the Company and are used strictly in accordance with the applicable data protection laws and the Company's internal policies.

4.6. Identification, contact data of clients, as well as data about the Services received by them, are contained in the user's cabinet on the platform and are not available for viewing by other users. Ordering services, the User independently determines which of his PD will be transferred to the Contractor for the provision of the Service. The User thereby gives consent to the Company to transfer the relevant PD of the Client to the appropriate Contractor to the extent determined by the Client. The Company is not responsible for the Contractor's processing of the Client's PD and for maintaining the confidentiality of such data by the Contractor; the Contractor is independently responsible for this.

4.7. The platform has the right to use and provide access to performers' personal accounts to review the information posted about the Performer (his level of qualification, range of services provided, etc.) and to allow anonymous comments, reviews, or surveys on the services provided by such a Performer for monitoring and analytics of such services and their quality.

4.8. In order to familiarize the Performer, who provides services, with certain information and to enable them to check information regarding the compliance of the provided Service with the expected Client's requests (how satisfied the Client is with the services received), including for analytical purposes and assistance to the Performer in improving their products, processes, and services, the Company may provide such information to the Performers: - the fact that the Client is registered on the platform; and - the fact that a particular Client is not registered on the platform; - the degree of satisfaction of the client with the provided service (including the provision of a review of the Service).

4.9. The company in any case does not distribute and does not provide access to any Performers and other persons regarding whether the Client received Services or any other information that can be provided using the platform by a certain Performer during a consultation. Such information may be used by the Performer who provided the Service to this Client and/or the Company to facilitate the future receipt/provision of services where further information may be needed to confirm the Client's right to receive services.

4.10. Information about Clients transferred to Performers is not intended for use by other persons.

4.11. If the Client has previously given his consent or has indicated that he does not object to providing his PD, which is used for the Company's marketing purposes, and later changes his mind regarding the Company's access to his PD, he can inform the Company to stop using such PD for marketing purposes by following the unsubscribe instructions in any messages sent to the Client.

4.12. During the processing of PD, the Company will undertake all necessary organizational and technical measures to protect PD from unauthorized or accidental access by third parties, destruction, alteration, blocking, reproduction, distribution, as well as other unauthorized actions. Processing of PD by the Company is carried out in ways that ensure the confidentiality of such data and comply with the legislative requirements for ensuring PD security.

5. Changes to the Policy.

5.1. The Company reserves the right to revise and amend the conditions of the policy.

5.2. In case of changes to the terms of the Policy, the Company will notify Users of such changes and update the Policy's edition when users access the Platform. Continued use of the Platform will be considered acceptance of such reviewed conditions, and the User is responsible for compliance with such conditions when using the platform. User access to the Platform after notification of changes to the Policy is evidence that the User agrees to the changed conditions.
