Terms of Service.
Please read all provisions of this Agreement carefully and make sure you understand them. You will be asked to agree (accept) this public contract before registering on the platform. If you refuse to accept the terms of the Agreement, you will not be able to register or use the iPsycholog Platform. LLC «PSYCHOLOG ONLINE» reserves the right to change the provisions of this Agreement from time to time in accordance with the terms of this Agreement. LLC «PSYCHOLOG ONLINE» considers the security and confidentiality of your information to be important. Public offer agreement. This document is an offer to conclude a contract under the conditions described below with any person who accepts (accepts) the terms of this public offer. The Agreement is a licensing agreement for the use of the platform, as well as establishes the general conditions for using the Platform and providing Services to Clients using the platform. The person unconditionally accepts the terms of the Agreement by placing a corresponding mark on the registration page. The actual use of the Platform also constitutes a person’s consent to this Agreement and acceptance of its terms. The agreement is in the nature of a public offer in accordance with applicable law (Art. 633, 634, 641, 642 of the Civil Code), the terms of this Agreement are the same and mandatory for all and apply to all services provided on the platform and all relations between users and between users and the Company.
1. Terms and Definitions
In this Agreement, the terms and definitions have the meanings given below:
«PLATFORM» - a set of software, data, payment facilities, storage and access to information contained on the Internet portal at the unique web address: ipsycholog.net and in mobile applications to meet the needs of Users.
«Agreement» - this public agreement, as well as all its appendices, changes and additions that may be made to the Agreement after the user joins it.
«GENERAL DATABASE» - the aggregate data of all users who have registered on the platform. The general database can be used for statistical reporting purposes without violating the confidentiality regime of User data.
«REQUEST» - A user's request for Service provision.
«SERVICES» - any kind of psychological services provided by the Provider to the User.
«INFORMATION SERVICES» - Services provided by Providers to the Client, in particular, but not exclusively: provision of information about psychologists, their qualifications, work schedule, cost of psychologist services; making electronic appointments and the like.
«USER» - an individual with full legal capacity who voluntarily uses the Platform to meet their needs.
«CLIENT» - a user who uses the Platform for obtaining informational and psychological services from Providers.
«PROVIDER» - a person providing various types of Psychological services using the platform.
«PSYCHOLOGIST» - an employee with the appropriate qualifications who, according to the law, provides psychological and informational services to clients using the platform and who: acts as a Provider, is registered as an individual entrepreneur, has a higher education diploma, or provides services as a self-employed person.
«PSYCHOLOGICAL SERVICES» - services directly or indirectly related to online client consulting using platform tools, in accordance with the law ensuring the confidentiality of the Client's request and the information provided by them in the course of providing this service.
«CLIENT'S PERSONAL ACCOUNT» - an electronic interface to access the Platform, which can be accessed by the Client with their personal access identifiers (username, password). The client's personal account contains the Client's Personal Data (PD) entered by the Client or the psychologist.
«PD» - Personal data of Platform users.
«ONLINE CONSULTATION» - a set of actions, technologies, and measures applied when providing psychological assistance using remote communication tools via the Internet, phone, audio, video, or electronic message exchange.
«PSYCHOLOGICAL COUNSELING» - providing psychological assistance to the Client by the Psychologist through online consultation. When providing psychological services, including using the Internet, the requirements of Ukrainian law regarding the protection of Personal Data and adherence to the rules and ethics of providing psychological assistance are met.
«LEGISLATION» - The legislation of Ukraine in effect at the time the user joins the Agreement or at the time of the dispute.
«RIGHTS» - Exclusive property rights of intellectual property.
«OBJECTS» - objects of exclusive intellectual property rights, including, but not limited to: copyright objects (software code, texts, images, video), industrial property objects (trademarks, layouts, labels, design) contained, will be used on the platform and related to its operation.
«COMPANY» - LLC «PSYCHOLOG ONLINE», EGRPOU code 38578224, owner of the platform acting independently or with the involvement of third parties and providing Users with a license (permission) to use the platform. The concepts and definitions listed in this section are used in the specified meanings, regardless of whether they are applied in singular or plural, written in uppercase or lowercase letters, except when a different meaning arises directly from the content of a specific article or paragraph of this Agreement. Other concepts and terms used in this document have meanings based on generally accepted interpretations or in accordance with established law, including international meanings.
2. SUBJECT OF THE AGREEMENT
2.1. The Company grants Users a license (permission) to use the platform for its intended functional purpose as an end user, and Users use the Platform in accordance with the provisions of the Agreement, and, in certain cases provided for by the Agreement, pay licensing fees for using the platform.
2.2. The scope of the Client's rights to use the platform. The Client is entitled to use the Platform within the limits permitted by the Company, including: a. Access the Platform using Internet browsers or mobile applications; b. Use the platform's functionality in compliance with the terms of the Agreement: - create a Client's personal account, enter their data and modify them; - receive Services from providers through the Platform, including psychological assistance through online consultations; - Use other functionalities designated as available for clients on the platform.
2.3. The scope of the Provider's rights to use the platform. The Provider is entitled to use the Platform within the limits permitted by the Company, including:
a. Access the Platform using Internet browsers or mobile applications;
b. Use the platform's functionality in compliance with the terms of the Agreement: - create a psychologist's personal account, enter their data and modify them;
- provide Services to Clients through the Platform, including psychological assistance through online consultations;
- Use other functionalities designated as available for providers on the platform.
2.4. The Company reserves the right to establish a fee for granting a license to use the Platform to Providers. If a fee is established for Providers' use of the Platform, the features of such use will be regulated by a separate agreement, concluded between the Company and the Provider, which will be made available to Providers for review upon registration on the platform and in the psychologist's personal account.
3. SPECIAL PRECAUTIONS.
3.1. The platform is a communication platform between Providers and clients, intended to facilitate independent Providers' provision of services with the client's consent and request. Responsibility for the quality, effectiveness, compliance, effectiveness, and cost of service provision lies solely with the Providers and Clients who use the Platform at their own risk and discretion.
3.2. The Company does not provide emergency, urgent psychiatric assistance or any services resulting in the provision of psychiatric assistance and/or diagnosis to the Client or any third party, and has no relation to and bears no responsibility for any services received by the Client from the Provider.
3.3. The Company is not responsible for the consequences caused by the provision of incomplete, unreliable information by the User; or the disclosure of confidential information by Users to third parties (e.g., providing their password, login) or posting information on the platform without appropriate rights to do so.
3.4. The Company is not responsible for consequences caused by differences in the rules for providing psychological assistance in Ukraine and other countries.
3.5. The Company is not responsible if the Platform is used or accessed in any country where it is illegal.
3.6. The Company reserves the right to change, supplement the procedure for providing services on the platform, the list, and sequence of user actions for further use of the Platform. Such changes and additions are made to the Agreement. User access to the Platform after such changes and additions are posted on the respective web page of the Platform is evidence that the User agrees to the modified terms.
3.7. The User is responsible for obtaining access to the data network necessary to use the Platform. When using the Platform with a wireless device, applicable communication service providers may charge SMS transmission and data transmission fees based on their mobile network rates, as well as fees for other services, telecommunication, and communication services.
4. ACCESS TO THE PLATFORM. REGISTRATION AND ACCESS.
4.1. Registration of the user is free, voluntary, and carried out on the platform at a special address on the Internet or through mobile applications.
4.2. The right to use the Platform for obtaining services is granted to persons who have reached the age of 18 and have full legal capacity.
4.3. If a User is a foreign citizen (a citizen of any country other than Ukraine), the User understands that the Company provides access to the Platform for Psychologists with appropriate qualifications and may deny access to the Platform if there are doubts about the qualifications of the foreign specialist.
4.4. After the User registers on the platform, they will be provided with a user ID, password, or other parts of information within the security procedure of the Platform and User data. The User understands and agrees that such information is confidential and not subject to disclosure to any third parties.
4.5. To gain access to the Client's personal account, the Client must perform the actions requested by the Platform for identification, by entering their email and password.
4.6. To gain access to the psychologist's personal account, the Psychologist must perform the actions requested by the Platform for identification, by entering their email and password.
4.7. The Company authorizes and grants access to the Platform to Psychologists only upon proof of appropriate qualifications. To verify the psychologist's qualifications, the Company has the right to request copies of diplomas, certificates, and any other documents during the psychologist's registration/authorization. The Company has the right to verify the validity of documents provided by the Psychologist during registration/authorization about education. The Company has the right to verify the psychologist's qualifications during the use of the Platform by the Psychologist. The Company may block any psychologist's access to the platform at any time, without notice, if there are doubts about the authenticity, sufficiency of evidence regarding the education and qualification of any psychologist.
4.8. The Company may at any time without notice and without explanation of such actions, revoke the license (access) to use the Platform by the User and disable any user ID or password chosen by the user or assigned by the Platform for access to the Platform, if the company will have concerns and be convinced that the User violates the terms of the Agreement or uses the Platform in violation of the law and the terms of this Agreement. ACCURACY AND COMPLETENESS OF INFORMATION.
4.9. The User is responsible for the accuracy, timeliness, and completeness of the information provided at the time of registration, as well as its compliance with the Legislation and does not violate the rights of third parties. If the User enters inaccurate data, the Company is not responsible for the functioning of the platform except for the obligations to maintain the confidentiality of Personal Data.
4.10. The Company is not obliged to check and modify information entered by users during registration and use of the Platform.
4.11. If the information provided by the User on the platform does not meet the requirements of the established and posted form on the platform or the provisions of the Law, the Company may deny such User access to the Platform.
4.12. By adding personal data on behalf of another person, the User confirms, guarantees, and agrees that he is responsible for: The User has the right to provide such data, including through its placement on the platform, and the provided data is accurate and up-to-date. PASSWORDS AND ACCOUNTS.
4.13. The User is solely responsible for the security of their passwords and the use of the user's account by third parties due to the user's fault (in case of loss or disclosure of the password by the user, hacking by the user's provider or Internet provider). In case of unauthorized use of the User's account on the platform by third parties due to the user's fault, the User is solely responsible for any damage caused by such unauthorized use by third parties.
4.14. If the User knows or suspects that their identification data for access to the Platform (login and/or password) is known to any third party, the User must immediately notify the Platform's technical support service by sending the appropriate notification via e-mail: manager@ipsycholog.net.
4.15. By registering on the platform (creating an account), the User agrees to receive text messages by email (E-mail), which is an integral part of the process of using the Platform. The User can refuse to receive emails from the Company at any time by sending an email to: manager@ipsycholog.net. In this case, the User acknowledges that refusing to receive emails may result in refusal of access to the Platform.
5. PROCEDURE FOR PROVIDING SERVICES.
5.1. Clients receive Services provided by Providers using the Platform.
5.2. Services include Psychological services, Informational services, and any other services. Services are provided at a price and under the conditions set by the Provider, in compliance with the provisions of the Agreement. ORDER.
5.3. To receive a Service, the Client forms and submits an Order in the prescribed form. When forming a request, the Client determines the scope of access to information and data placed by them on the platform, to which the Provider may have access using the Platform.
5.4. The order is subject to registration on the platform in the appropriate section/category (Client's cabinet), or in the section of the specified Provider (if the Provider is specified by the Client in the order form).
5.5. After the order is registered, it is sent to a Provider with the necessary specialization, in the amount of information necessary to provide the Service, within the access provided by the Client to such information and data. PSYCHOLOGICAL SERVICES.
5.6. Psychological services are provided exclusively by Psychologists who have the appropriate qualifications and education.
5.7. Psychological services are provided using the platform in the form of an online consultation.
5.8. Paid psychological services are conducted on a prepayment basis, which must be made no later than three hours before the start of the consultation.
5.9. Prepayment is non-refundable if the service is provided in full, namely - the start time and duration of the consultation.
5.10. Psychological services are provided in the volume allowed by the technical means of the Provider (tools and software used by the Psychologist) and the Client.
5.11. The Company is not responsible for the consequences of the Client's actions based on recommendations and instructions provided by the psychologist to the Client on the platform.
INFORMATIONAL AND OTHER SERVICES.
5.12. Informational services and any other services can be provided by both Psychologists and other Providers.
5.13. Informational services are provided exclusively to provide the Client with the information necessary to organize the process of psychological assistance. SERVICE RESULT.
5.14. Upon completion of the services, the Provider makes the appropriate entry in the appropriate section of the Platform with the indication of the date of the Service or refusal/redirect (with reasons) of the Service, the scope of possible recommendations. Access for the Provider to such information is further provided without restriction.
6. PLATFORM USAGE.
6.1. Although the Company makes every effort to avoid interruptions or unavailability of the platform, it does not guarantee that the platform or any information posted on it will always be available or uninterrupted. Access to the Platform within one session (one Service initiation; entering the Patient's personal account) is granted to the User temporarily.
6.2. To successfully access the platform, the User is responsible for taking all necessary steps for such access, as detailed on the respective Platform pages.
6.3. Any information posted and reflected for visual familiarity on the platform is intended solely for informational and educational purposes. Such information is posted «as is» without any guarantees or liability for its contents on the part of the Company.
6.4. User statistics on the effectiveness and feedback on services and platform use provided on the platform are based on internal and/or external surveys and may change without prior notice to the user.
6.5. By using the Platform, the User agrees that any information provided is accurate, correct, and truthful, not misleading, and that the User has the right to provide, distribute, and post it on the platform.
